These Terms of Service govern your use of the website hariketransportpty.site and any transport and freight services provided by Harike Transport Pty Limited (ABN 98 702 105 306) (“we”, “us”, “our”). By engaging our services or using this website, you agree to be bound by these terms. If you do not agree, please do not use our website or services.
1. About these terms
These terms apply to all quotations, bookings and transport and freight services we provide throughout Perth and regional Western Australia. Where we issue a quotation or confirm a booking, these terms form part of the agreement between you and us, together with any written quote or booking confirmation we provide.
2. Our services
We provide transport and freight services, including local and linehaul cartage, general freight movement and related logistics support. The specific scope, timing and price of any service will be set out in your written quotation or booking confirmation. Descriptions of our services on this website are general in nature and do not constitute an offer to provide services at any particular price or time.
3. Quotations and bookings
- Quotations are valid for the period stated on the quote, or 14 days if no period is stated.
- Quotations are based on the information you provide to us, including the nature, weight, volume and destination of the freight. If that information proves inaccurate, we may adjust the price accordingly.
- A booking is confirmed only when we accept it in writing. We reserve the right to decline any booking.
- Indicative timeframes are estimates only and are not guaranteed delivery times unless expressly agreed in writing.
4. Payment terms
- Unless otherwise agreed in writing, payment is due within 14 days of the date of our invoice.
- We may require a deposit or full prepayment before commencing certain services.
- Invoices are payable in Australian dollars and include GST where applicable.
- Overdue amounts may accrue interest and we may suspend services until outstanding amounts are paid.
- You must pay any reasonable additional costs arising from instructions you give us after a booking is confirmed, including waiting time, redelivery or storage.
5. Cancellations and changes
If you cancel or vary a confirmed booking, we may charge reasonable costs already incurred, including fuel, labour and vehicle time. Requests to cancel or vary must be made in writing to ceo@hariketransportpty.site. Where practicable, we will give you as much notice as possible if we need to reschedule a service due to operational, weather or road conditions.
6. Freight, access and site conditions
- You must ensure that freight is properly packed, labelled and suitable for transport, and that it complies with all applicable laws, including any requirements for dangerous or hazardous goods.
- You must provide safe, legal and reasonable access to pickup and delivery locations, including appropriate parking for our vehicles.
- We may refuse to carry freight that we reasonably believe is unsafe, improperly packed, unlawful or likely to damage our equipment or other cargo.
- You must declare the correct nature and value of your freight. We may require evidence of the condition of freight at pickup.
7. Your obligations
You warrant that you are legally entitled to request our services and to provide us with the freight and information you give us. You must comply with all reasonable safety and site directions given by our personnel. You must not use our website to submit false, misleading or abusive requests.
8. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation, including the consumer guarantees. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to cancel your service contract with us and to a refund of the price you have paid, or compensation for its reduced value. For a major failure with goods that were part of a service, you are also entitled to a replacement or repair of the goods. For minor failures, we may choose to provide a remedy within a reasonable time or compensate you for the reasonably foreseeable loss or damage.
9. Liability
To the fullest extent permitted by law:
- We are not liable for loss of profits, loss of business, loss of anticipated savings, or any indirect or consequential loss.
- Where liability cannot lawfully be excluded, our total liability for any claim is limited, at our option, to resupplying the relevant service or paying the cost of having the service supplied again.
- We are not liable for delays or failures caused by events beyond our reasonable control, including extreme weather, road closures, accidents, industrial action or mechanical breakdown.
10. Indemnity
You indemnify us against any loss, claim or expense arising from your breach of these terms, from inaccurate information you provide, or from the unlawful nature, packaging or content of freight you ask us to carry, except to the extent caused by our negligence.
11. Force majeure
We will not be in breach of these terms if performance is prevented or delayed by an event beyond our reasonable control. Where such an event occurs, we will notify you as soon as reasonably practicable and work with you to find a reasonable alternative arrangement.
12. Privacy
We handle personal information in accordance with our Privacy Policy. By using our website or services, you consent to that handling.
13. Intellectual property
All content on this website, including text, graphics and layout, is owned by or licensed to Harike Transport Pty Limited. You may not reproduce or reuse it without our written permission, except as permitted by law.
14. Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the jurisdiction of the courts of Western Australia.
15. Changes to these terms
We may update these terms from time to time. The current version will always be published on this page with a revised “last updated” date. Continued use of our website or services after changes are published constitutes acceptance of the updated terms.
